Well, Twitter is all a…..well, a twitter, over the new Netflix movies ‘Cuties’. This is a French film that’s a Sundance award winner with a female director. However, it’s also very, very provocative and is either attempting to make a point, or is child pornography. I hope that the most important thing that we take away from the Kenosha unrest is that making a decision about a situation in one or two sentences of a news headline is not the full picture. The media has been taking the Jacob Blake shooting and creating a narrative juxtaposing it to the Kyle Rittenhouse shooting.  When the facts of these two situations are evaluated they are not the same in many regards. They are the same in that they are both avoidable. First, both situations are still under investigation and developing. Kyle Rittenhouse is in custody with murder charges (among others) pending. Jacob Blake is in the hospital paralyzed and recovering from 7 gunshot wounds.  But let’s discuss the surrounding situations based on the information available. Jacob Blake has pending charges arising out of a sexual assault and domestic violence case. There seems to be a restraining order in relation to those charges. Jacob Blake showed up at the victims’ house, broke in, attempted to steal her car resulting in her calling the police. When the police showed up to arrest Jabob Blake with the outstanding warrant and apparently violated the restraining order. He then wouldn’t comply with the police was Tasered twice, and reached for a weapon whereupon he was shot. The circumstances surrounding this are avoidable. Kyle Rittenhouse at 17 decided to head into Kenosha, an already tense situation, with an AR15 that he wasn’t supposed to be carrying based on his age. He then stayed in the area late into the night, he wasn’t questioned about his weapon (though open carry laws mean that people were walking around legally carrying similar weapons), he kept moving with the crowds of protestors until there was a confrontation. What we know from the video is that a protester behind Kyle Rittenhouse fired a weapon and Kyle turned around and fired injuring a protestor. The crowd turned on Rittenhouse, he was knocked to the ground protestors attempted to disarm him and he killed two. He shouldn’t have had that weapon. He is too young to be trusted to make good decisions in a dangerous situation he put himself in. He made these decisions that ended the lives of two people, this doesn’t discount the decisions of the protestors who were attacking someone armed with an AR15 cause that seems like terrible decision making too. The Britney Spears Conservatorship is the backdrop of the Free Britney movement….wait the #FreeBritney movement. Her fans have demanded that attention is turned to the over 12-year conservatorship that has been granted to Britney’s father Jamie Spears. The conservatorship was set to expire in August 2020 but was extended until February 2021 while the court asks for additional legal motions. Britney has recently spent time in a mental health facility which some argue was a tactical move by her father to keep the conservatorship going, or as necessary to support her in light of her fathers health struggles. There is a lot of behind the scenes that we don’t know here, because of the nature of the conservatorship. It’s meant to be private but is it time to transition to allowing Britney to have more freedom. To be able to choose if she wants to have another child, to get married, to drive her car. President Trump has recently signed quite a few Executive Orders that have garnered attention for a number of different reasons. I am personally most fascinated by the President taking on social media in different ways. A lot of the laws regulating the online space were written in the 90’s, long before social media as we know it was in existence. This clearly presents issues for government, employers, and society. Some of those decisions may be out of our hands  if these new Executive Orders stand. The President has gone after TikTok, Facebook and Twitter by way of trying to open the door for platforms to be sued over censorship. I have thoughts... I have made it pretty clear that I think Rachel Hollis is a fakey faker. Her brand of toxic positivity wrapped with curated authenticity just pisses me off. The announcement of her new book “Didn’t See that Coming” like a month and a half after she announced her divorce from Dave Hollis on Instagram just put me over the edge with it. I am outraged and the unyielding monetizing of bullshit. Rachel Hollis made clear in her divorce announcement that their marriage had been struggling for the last three years….and during that time she has released books, coaching, marriage retreat weekends and podcasts on the topic of having an epic marriage. It’s all such bullshit. She posted on Instagram in May that her new book was into the publisher, seemingly days after she told Dave that their marriage was over. This despite the fact that in ‘Girl Wash Your Face’ she describes divorce as not an option, that anything can be solved with communication, sex toys, and making out. So she is fine selling this to her audience but not following the advice for herself. All of it is overwhelmingly gross. She built an empire on marketing a life she wasn’t living. My Journey. I started my journey long before I quit my career as a District Attorney. There were lots of little moments that lead up to big life decisions. The death of Breonna Taylor is absolutely tragic. There is no arguing that. What I have learned in over 10 years as a prosecutor though is that tragic circumstances don't necessairly mean it’s illegal. Additional charges were filed against Derek Chauvin, the other three officers involved in the attempted arrest and death of George Floyd have been arrested and charged. The Medical Examiners office updated its provisional autopsy report. When I get asked to talk about what I think might happen in this case I look for context from other similar cases. In Minneapolis Minnesota there is one, the death of Justine Ruszcyk who was shot and killed by officer Mohamad Noor in July 2017. The killing of George Floyd has rocked the US and sparked protests around the world. Police officers are rarely charged with Murder in discharging their duties and there is no disagreeing that what Derek Chauvin did was a crime and not policing.  There was outrage at the charges filed, third-degree Murder and Second Degree Manslaughter. Breaking down what these changes mean, what the murder and manslaughter statues look like in Minnesota, and how they apply to this case will hopefully be a helpful step in understanding what is happening. When States started shutting down I knew there would be waves of COVID related lawsuits. Guess what...my crystal ball is right, the first wave is here. We will see litigation over COVID for years to come. First....Congress passed additional funding for the PPP on April 21st and I expect it to be signed into law this week and funds should start rolling out soon. I will be updating that in the Facebook Group!If you are angry, confused or frustrated about the PPP and the way the Stimulus checks are rolling out, you are not alone. There is nothing short of outrage over the Paycheck Protection Program funds going to large publicly traded companies. RANT Ahead....I am kinda pissed about the way small business, independent contractors and the self-employed are being treated. I have long said that the way to get ahead and live 'the American dream' is through business ownership. The tax laws are business friendly, there are a tremendous amount of options for how to structure your work and your life. I have also said that it's not for the faint of heart. The situation with Coronavirus, the Paycheck Protection Program and the SBA loans have highlighted what types of businesses are favored. As small business owners are put last in line for aid, struggle to find lenders and are unsure when they will receive money larger businesses are able to apply through their regular banks due to existing relationships.
