Privacy Policy – Effective as of May 25, 2018

At Podchaser we take the security of your personal information seriously. To this end, this Privacy Policy discloses our privacy practices and the possible uses of the information that Podchaser, LLC (“Podchaser”) gathers via our website at http://www.podchaser.com, the Podchaser mobile application, and any other submissions by you to Podchaser (together, the “Services”). This Privacy Policy is a part of our Terms of Service.

BY INSTALLING, USING, REGISTERING FOR OR OTHERWISE ACCESSING THE SERVICES, YOU AGREE TO BE BOUND BY THIS PRIVACY POLICY, AND GIVE AN EXPLICIT AND INFORMED CONSENT TO THE PROCESSING OF YOUR PERSONAL DATA IN ACCORDANCE WITH THIS PRIVACY POLICY.  IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, YOU SHOULD NOT INSTALL, USE, REGISTER TO OR OTHERWISE ACCESS THE SERVICES. 

We may update this Privacy Policy from time-to-time at our sole discretion and you are bound by any changes we make. It is your responsibility to review our Privacy Policy for any changes each time that you use our Services. Use of the Services by you following the posting of a new privacy policy on our website at http://www.podchaser.com constitutes your acceptance of the revised Privacy Policy.

Information and Uses of Information

Podchaser collects information about you and other users in a variety of ways.  These include, but are not limited to, through your voluntary submissions and participation in and access to the Services, as well as through cookies and other tracking technology. The information we collect can and often is used in a variety of ways, including to improve our Services, to notify you about updates to our Services, or promotions that you may be interested in, and to fulfill and provide the Services you have requested.

The information we collect currently includes, but is not limited to, the following:

Personal Information

For purposes of this Privacy Policy, “Personal Information” refers to information that tells us specifically who you are, such as your name, phone number, email, postal address, and may also include information about certain support or customer service issues. In many cases we need this information to provide you with some or all of the Services you have requested. We also use Personal Information to manage and/or monitor user activity, and otherwise to improve our Services. We might ask for or collect additional Personal Information in the future.

When and how we share your personal information

We do not disclose Personal Information to third parties, except when one or more of the following conditions is true:

Prior to sharing of your Personal Information with others, we typically enter into agreements with such outside parties. If Podchaser becomes aware that any of these outside parties is improperly using or disclosing Personal Information, we will notify that outside party and request that it take reasonable steps to stop such use or disclosure.

Non-Personal Data

For purposes of this Privacy Policy, “Non-Personal Data” means information that does not directly identify you.  Non-Personal Data includes “aggregate” and “de-personalized” information, which is data we collect about the use of Podchaser, from which any personally identifiable data has been removed.

Podchaser may use tools or third party analytical software to automatically collect and use certain Non-Personal Data that does not directly enable Podchaser to identify you.  The types of Non-Personal Data Podchaser may collect and use include, but are not limited to: (i) device properties, including, but not limited to unique device identifier or other device identifier; (ii) device software platform and firmware; (iii) mobile phone carrier; (iv) geographical data such as zip code, area code and location; and (v) other Non-Personal Data to help us enhance our Services.

Aggregate Information

From time-to-time we may collect general, non-personal, statistical information about use of the Services.  This statistical information may include how many visitors visit a specific page on our Website or in our mobile apps, how long a user stays on that page, and which hyperlinks or buttons, if any, they click on. This information represents a generic overview of our users, and allows us and other third parties to modify information, promotions, offers and/or products and services based on user traffic and behavior.  We collect this information through the use of technologies such as ‘cookies’ (see below), and use this information to, among other things, enhance our Services.  We may also group this information into aggregate visitor data in order to describe the use of the Services to existing or potential business partners or other third parties, and to optimize third-party offers of products and/or services. We also may share aggregated demographic and preference data with third parties to enable the provision of targeted information, promotions, offers and/or products and services.

Cookies and Other Tracking Technologies

Podchaser may collect non-personally identifiable information and data through the use of cookies and other tracking technologies. Cookies are small text files placed on your computer through your browser when you visit a web site. Cookies are also used by Podchaser to recognize and authenticate users when they return to our Website, and to facilitate the user’s ongoing access to, and use of, the Website.  Cookies also allow a website to track usage behavior and compile site usage information that will allow for the improvement of content and target advertising.  Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. Should you elect to block cookies with your browser, please keep in mind that some features of our Services may not function or may be slower.  You may occasionally get cookies from our advertisers or other third parties. We do not control these cookies. The use of advertising cookies sent by third party ad servers is standard in the Internet industry.

Tracking technologies may record information such as Internet domain and host names; Internet protocol (IP) addresses; browser software and operating system types; clickstream patterns; and dates and times that our Services are accessed.  Web servers automatically identify your computer by its IP address. We may link the information we record using tracking technologies to Personal Information we collect from you for our own marketing and advertising purposes. Additionally, we reserve the right to use IP addresses and other tracking technologies to identify a visitor when we feel it is necessary to enforce compliance with our Terms of Service, to protect our Services, our customers or others, or when we reasonably believe that the law requires it.

You recognize and agree that the analytics companies and marketing partners utilized by Podchaser may combine the information collected with other information they have independently collected from other services or products relating to your activities. These companies collect and use information under their own privacy policies.

Data Security

The Personal Information you provide and we collect is stored within databases that we control directly or through our service providers.  We use those security measures we deem appropriate and consistent with industry standards, such as firewalls, to protect your Personal Information.  However, since no security system is impenetrable, we cannot guarantee the security of our databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to or by us over the Internet.

Your information may be transferred to, and maintained on, computers located outside of your state, province, or country, and where the privacy laws may not be as protective as those where you live.  If you are located outside the United States and choose to provide information to us, you should remember that we transfer Personal Information to the United States and process and store it there.  By submitting your Personal Information, you consent to having your personal data transferred to, processed, and stored in the United States.

Children’s Privacy

We do not knowingly collect any Personal Information about children under 13 years of age. If we become aware that we have unknowingly collected Personal Information from a child under the age of 13, we will make commercially reasonable efforts to delete that information from our database.

Links to Other Sites

Our Services may contain hyperlinks and/or pointers to Internet sites maintained by other third-parties. These links are provided for your reference only. We do not control, operate or endorse any information, products or services originating on or from these third-party sites, and we are not responsible, in any respect, for their content.  Many third-party sites have their own privacy policies that may differ from this Privacy Policy which only covers our Services and does not cover any other site. While we make every effort to keep your information secure, we neither guarantee, nor control, the policies of other third-party sites.

Opt-Out

You can also ask us whether we are keeping information about you; how your information is being used; update or delete your information, or opt-out of the collection and use of certain information by sending an email or by writing to us specifying the nature and scope of your request. If you choose to delete your information or opt-out of the collection and use of your information, you understand that the Services may no longer be available to you. Please state in your correspondence the details of your request. We may require proof of your identity before we provide you with the requested information. We allow you to challenge the data that we hold about you and, where appropriate, you may have the data erased, rectified, amended, or completed. We will use commercially reasonable efforts to process approved requests within ten (10) business days of the date on which we receive the request.

Email

From time to time we may contact you with relevant information about the Podchaser Services and our other products and services. Most messages will be sent electronically. For some messages, we may use personal information we collect about you to help us determine the most relevant information to share with you.
If you do not want to receive such messages from us, you will be able to tell us by selecting certain boxes on forms we use when we first collect your contact details. You can also change your marketing preferences at any time by following the unsubscribe link at the bottom of our emails.

 

Governing Law; Visitors Residing Outside the United States

This Privacy Policy and the privacy practices of Podchaser will be subject exclusively to the laws of the State of Delaware, without regard to its conflict of law principles. Podchaser makes no representation that this Privacy Policy and such practices comply with the laws of any country outside the United States.

International Data Transfers and Privacy Shield

Podchaser is based in the United States. Your information, including personal information that we collect from you, may be transferred to, stored at and processed by us and our affiliates and other third parties outside the country in which you reside, including, but not limited to the United States, where data protection and privacy regulations may not offer the same level of protection as in your jurisdiction. We will take all reasonable steps to ensure that your data is treated securely. References to “personal information” in this Privacy Policy are equivalent to “personal data” governed by European Union data protection legislation.

European data protection laws give you certain rights regarding your personal information. You may ask us to take any of the following actions in relation to your personal information that we hold: (i) opt-out of direct marketing communications; (ii) provide access to your personal information; (iii) update and/or correct inaccuracies in your personal information; (iv) delete your personal information; (v) restrict processing of your personal information; and (vi) object to our reliance on our business interests as the basis of our processing of your personal information.

Whenever we transfer your personal information out of the EEA to countries not deemed by the European Commission to provide an adequate level of personal information protection, the transfer will be based on one of the following safeguards recognized by the European Commission as providing adequate protection for personal information, where required by EU data protection legislation: (i) contracts approved by the European Commission which impose data protection obligations on the parties to the transfer; or (ii) for transfers to third parties in the United States, ensuring they participate in the EU-US Privacy Shield Framework.
