When you're ready to ride Metro, we want

0:03

you to know we're ready for you. Here

0:05

are just a few of the people at Metro to tell

0:07

you how we're doing our part to keep riders

0:10

safe. We're cleaning like Noble before,

0:12

half builded greatly. You've found

0:14

half stut of no

0:18

mask, no Metro me one.

0:20

We have a few extras at Metro. We're

0:22

doing our part to keep the DC area moving.

Armstrong and Getty Show, Kamala

0:38

Harris is a lame excuse for why she's

0:40

failing. Coming up in Marshall's News In about

0:42

ten minutes before that, we got Tim the lawyer

0:44

in the studio. Tim Sanderford, vice president

0:47

for Litigation at the Goldwater Institute,

0:49

where they busily fight for liberty.

0:52

Perhaps you've heard of it. What have you guys

0:54

been doing lately? A couple of wins? Huh yeah. We want

0:56

a couple of cases in one in Florida and one in

0:58

California involving home sharing, you know where

1:00

people allow people to stay in their homes

1:03

like an Airbnb or home away or something like that,

1:05

and a lot of communities across the country

1:07

are trying to violate people's private property

1:09

rights by telling them that they're not allowed to do that and

1:12

imposing these blanket bands and and

1:14

and so forth. So we this is an

1:17

issue that that we've really taken on at the Goldwater

1:19

Institute, and we want a case in Pacific

1:21

Grove, California, just recently where

1:23

the court there said that that violated the California

1:26

Coastal Act. Now that's interesting because

1:28

the California Coastal Act says that the Coastal Commission

1:30

has the authority to set the rules for how people

1:33

use their land along the coast. And usually they're very

1:35

anti private property rights, environmentalist radicals,

1:38

but in this case, they actually like home sharing because

1:40

it's a way of allowing people to to to spend

1:42

the weekend and enjoy the beach without building

1:45

new hotels and things like that. So they're

1:47

actually rather pro home sharing. So they've said

1:49

that they don't want cities to outlaw people

1:51

allowing allowing people to use their homes.

1:54

So we won that case in the trial

1:56

court recently, and we want an even bigger case in Florida

1:59

where they were uh that that community

2:01

in Miami Dade County was prohibiting

2:04

people from using their homes for short

2:06

term rentals with these incredibly exorbitant

2:08

fines like hundreds of thousands of dollars

2:11

per violation, which we said violated

2:14

the constitutional prohibition on excessive

2:16

finds because both the federal and state constitutions

2:19

prohibit the government from imposing these excessive

2:21

fines. And fortunately, Florida

2:23

state law also said the same thing.

2:25

It's set the number the amount of finds

2:27

that cities are allowed to levy. And the court said that that was

2:30

illegal, that what the city was doing, and

2:32

struck down the entire ordinance. So

2:35

we're still doing some cases in places like Illinois,

2:37

for example, where Illinois Chicago's

2:40

rule on home sharing is you have to get a license,

2:42

and when you get a license, among other things,

2:44

the city is allowed to search your property

2:46

quote at any time and for any

2:48

reason. Wow, expended

2:53

amendments and and we're not talking

2:55

and you know, we're talking about people's homes here, you

2:57

know, so it's it's even more extreme than that. It's just in

3:00

So unfortunately, this is one of those situations

3:03

where nimbiism and this

3:05

this this basic fundamental

3:07

premise people have that they have a right to

3:10

tell other people how to live their lives is

3:12

so deeply rooted that even people

3:14

that you talk to who normally say, well, I'm in favor

3:16

of private property rights and limited government in the constitution,

3:19

many of them will even turn around and say, well, but I have a

3:21

right to tell my neighbor what he can do with his land. Now,

3:24

we're not saying that that people should be allowed to have

3:26

loud party houses or something like that.

3:28

Of course, the city should be able to crack down on

3:31

nuisances, on noise and things like that. But

3:33

you don't ban all backyard barbecues

3:35

just because sometimes people get a little rowdy, or

3:37

or make it illegal to have a Super Bowl party just

3:40

in the entire city, just because sometimes one

3:42

or two people have too much parking

3:44

on the street or something. But that's the way this is

3:46

being approached nationwide, and

3:48

it's a real shame because home sharing is good

3:50

for local economies. It brings tourists

3:52

into into towns to patronize

3:54

local businesses and restaurants that otherwise would

3:57

never go. I mean, I've I've done this. I was

3:59

in too a vacation to New Orleans not

4:01

long ago and stayed at a home sharing

4:03

at a home and we we went all to to all

4:05

these little local restaurants and things. We would

4:07

have never gone there if we had stayed at the big hotel

4:10

downtown. So this is another situation

4:12

where trying to dictate to other

4:14

people how they use their property and how they

4:16

live their lives is also bad for

4:18

the economy and bad for for people

4:21

who need homesharing to pay their bills. You

4:23

lift up your shirt and get some beads in New Orleans, You

4:25

know I probably could

4:29

I stopped. I saw McDonald so much

4:31

nowadays. What's your Twitter feed? Because

4:33

you got one of the best Twitter feeds out there. It's

4:35

my my full name at Timothy Sanda for which

4:38

I probably should have shortened because it takes

4:40

up too many letters. Well, it shows

4:42

up on our Twitter feed a lot, and I'm glad you fight for

4:44

You ever consider doing slipping falls? No.

4:48

I went to law school because I wanted to sue the government.

4:50

It's the best the world. I would do it

4:52

for free if I had to. In fact, I sort of do

4:54

because I don't charge my clients. And by

4:56

the way, we have supported entirely by donations

4:58

from people who agree with the things that we do. We're

5:00

having our big annual gala

5:03

dinner in Phoenix on Friday,

5:06

and if if folks out there, if any of you would like

5:08

to come along, go to Goldwater Institute

5:10

dot org. You can find out about the dinner

5:12

on Friday. You can find out about the stuff that we do. We

5:14

have a blog where we follow all the all the stuff that we're

5:17

engaged in across the country Goldwater Institute

5:19

dot org. Tim is going to stick around for a little bit and I have

5:21

some questions about some of the stories of the day

5:23

and how they fit into liberty

5:26

and freedom in the law and that sort of thing. Marshall's got

5:28

his news in just a few minutes, and we'll check out on where

5:30

we are with the latest and all the dang

5:32

stories that we're following. Dang story democratic

5:34

grace and impeachment and whatnot on the arms
