important in establishing his potential

motive for the killing. It

was the prosecution's belief that Bogdanov

was so angry that he had been deceived
1:01:25
by the very kind of person he so openly
1:01:28
despised. That murder was

tragically the outcome. Due

to Boggana's religious background and rigid
1:01:35
family beliefs, he could not let anyone

find out that this event occurred. He

simply could not endure or live
1:01:42
down that kind of embarrassment as

he suggested while openly weeping in
1:01:46
court. Therefore, he
1:01:49
chose to dispose of Nikki's body

and carry on with life as though nothing

ever happened. Overall,

it was the prosecution's stance all
1:01:58
along that Nikki was killed solely
1:02:00
because she was trans, not because
1:02:02
she ever imposed any realistic threat
1:02:05
toward David Boggana. In

the end, it would be up to the jury to
1:02:09
decide. And after less than
1:02:11
two weeks, a unanimous verdict had
1:02:13
been reached.

On August twenty seventh two thousand

twenty one, twenty seven year old

David Bogg Johnav was found guilty

of second degree murder and malicious
1:02:31
harassment in the death of Nikki Kuhnhausen.

A few weeks later, he was sentenced to

the maximum allowable term for the convictions,
1:02:40
nineteen and a half years in prison.
1:02:43
In the state of Washington, a point system
1:02:45
is used during the sentencing phase of criminal
1:02:47
trials. The fact that David
1:02:49
Bogdanov did not have any significant
1:02:51
points or prior criminal history. weighed
1:02:54
greatly in determining how much prison time
1:02:56
could actually be handed down. While
1:02:59
a nineteen and half year sentence doesn't
1:03:01
seem adequate in comparison to
1:03:03
a human life lost. There were
1:03:05
some positive changes that came as
1:03:07
result of this case. March

fifth of two thousand twenty, Governor

Jay Inslee signed the Nikki Kuhnhausen
1:03:14
Act into law. The legislation
1:03:17
was designed to prevent the defendants who
1:03:19
were charged with violent crimes from
1:03:21
using a sexual orientation as
1:03:23
part of their defense. This
1:03:25
is more commonly known as the gay
1:03:27
or trans panic defense. While
1:03:30
Bob Donovan did claim self defense
1:03:32
in this case, there was a lot of
1:03:34
gray area and debate as to how
1:03:37
his legal representation gated
1:03:39
this thin lie. Regardless,
1:03:41
Nikki's law will abolish this legal
1:03:44
strategy altogether and prevent
1:03:46
it from ever being used again in the state
1:03:48
of Washington The justice
1:03:50
for Nikki task force played a pivotal
1:03:52
role in bringing these issues to the
1:03:54
forefront and essentially pushing
1:03:56
this law through their local government One
1:03:59
of the
1:03:59
founders of Nikki's task force, Linden

Walls, is someone who believes that because
1:04:04
legal strategies such as the gay
1:04:06
trans panic defense still exist.

There is still much work to be
1:04:11
done. Yeah.

with Linden about their involvement in

this case. the great loss that occurred,

and also what's been accomplished since
1:04:27
as well. Linen spends
1:04:30
a great deal of personal time in Vancouver
1:04:32
helping people in the transgender community
1:04:34
to feel safe. Professionally,
1:04:37
Linden works as a digital marketing coordinator
1:04:40
organizing social media campaigns
1:04:42
for small and medium sized businesses
1:04:44
in and around the city. We
1:04:46
were curious about how Linden first
1:04:48
learned of Nicki Kuhnhausen, And when
1:04:50
it was, they decided to get involved.
1:04:53
I first heard about Nikki Nikki
1:04:56
missing when Lisa
1:04:58
filed a police report and
1:05:00
local organization started helping flier
1:05:03
the area. So that was early
1:05:05
June. For me, the drive
1:05:07
to get involved with Nikki case was knowing
1:05:09
that a local trans team
1:05:12
had gone missing, and I got
1:05:14
involved after her remains had been found.
1:05:16
So her remains were found,
1:05:19
and then the task force kind of
1:05:21
was formed headed up by Devin Davis.
1:05:23
And Devin reached out to me, we had lunch,
1:05:25
and she was like, I need your help. So I
1:05:27
got involved because of my
1:05:30
love for the Vancouver community and
1:05:32
the Portland community and wanting
1:05:34
to make sure the trans story
1:05:37
was heard that that was
1:05:39
a part of the
1:05:41
prosecution's understanding of the
1:05:43
case because initially David
1:05:45
was not charged with the hate crime.
1:05:47
He was initially only charged
1:05:49
with murder. After
1:05:50
teaming up with Devin Davis and with
1:05:53
Linden's professional background, and
1:05:55
capturing eyes via online marketing.
1:05:57
The murder of a seventeen year old transgender
1:06:00
woman started getting a lot of attention
1:06:03
as intended. Nikki's
1:06:05
task force would allow her murder to be
1:06:07
ignored. Posthumously, Nikki
1:06:10
Kuhnhausen would become the vehicle of awareness
1:06:12
with the already volatile crime rate toward
1:06:15
gay and trans people in America. Linden
1:06:18
expands on why it was so important to
1:06:20
be vocal and vigilant. believing
1:06:22
that a precedent needed to be set.
1:06:25
Fortunately
1:06:25
for a lot of trends, people who
1:06:27
are murdered, people
1:06:29
aren't even found,
1:06:31
and so there is no prosecution in
1:06:34
a lot of cases. So, you
1:06:36
know, when when the murder of a trans
1:06:38
person does go two trial. Oftentimes,
1:06:41
it is a really gray area. Did this happen
1:06:43
because this person was trans or did this
1:06:45
happen of another circumstance.
1:06:48
And so a lot of times these types
1:06:50
of trials get acquitted or
1:06:53
end in a mistrial.
1:06:55
This gray area brings us back to the, quote,
1:06:58
trans panic defense. And if
1:07:00
Boggdonna have actually used it or
1:07:02
not, We wanted to get
1:07:04
Linden's thoughts on the matter.
1:07:06
Well, because Nikki's law
1:07:08
wasn't passed until after the murder
1:07:10
happened, he
1:07:12
could use that defense if he wanted,
1:07:14
and there wasn't anything that could
1:07:16
go back and retroactively stop that.
1:07:19
You know, it's very thin line
1:07:21
on whether or not he used it. And
1:07:23
that's, I guess, what a lot of people end
1:07:25
up talking about is, did he use a veiled
1:07:27
version of the Transatlantic Defense or
1:07:30
did he truly use a self defense
1:07:32
defense? We
1:07:34
also discussed David Bogdanov's testimony.

Linninn made the observation that Boggadonna
1:07:40
have constantly brought up religion, almost
1:07:42
as a way of justifying or at
1:07:44
least explaining his actions. A

feeble attempt to connect with the jury
1:07:49
seems to be the overall consensus here.

If you listen to David's full

testimony, a lot of it,
1:07:57
he talks about his religious beliefs
1:07:59
and how that motivated

his
1:08:03
world view on gay queer people.

It was a a hail Mary,

I guess, to maybe hopefully get

some people to believe them. But There
1:08:13
are undoubtedly many religions
1:08:15
that still openly denounce or do
1:08:17
not accept gay or trans lifestyles
1:08:19
and people. However, thou
1:08:21
shalt not kill is a pretty universal
1:08:24
ideology on that David
1:08:26
perhaps missed or slept through in bible
1:08:28
study. religious or
1:08:30
not, if you murder someone, gay,
1:08:32
trans or straight, and you're found
1:08:35
guilty for that crime, you go
1:08:37
to prison. Regardless, we
1:08:39
wanted to gain Linden's perspective on
1:08:41
the sentencing in this case as someone
1:08:43
who was there as it all unfolded.
1:08:46
So I think amongst the community, the
1:08:48
feeling was in the
1:08:51
in the Nike task force, at least we knew
1:08:53
that that this was best case scenario
1:08:55
was that nineteen and a half years was
1:08:58
the most that the judge would be
1:09:00
able to sentence him to if
1:09:02
he was found guilty on both counts he
1:09:06
didn't have any other
1:09:08
aggravated kind of stuff. He
1:09:10
didn't have any other criminal record
1:09:13
that
1:09:15
push him over to getting
1:09:17
more time. So because he had never been
1:09:19
found guilty of anything and just had minor
1:09:21
African fractions. You know,
1:09:24
Washington is on the sentencing schedule that's
1:09:26
based on prior offenses. So
1:09:28
he got the extent of what was
1:09:31
available to be given to him. And
1:09:34
the judge, I think, had kind
1:09:36
of expressed I
1:09:38
perceived him to have expressed in his
1:09:40
closing remarks before the sentencing how
1:09:43
dark and vicious this murder was
1:09:47
and that he wished that he could give him
1:09:49
more time, and he gave him
1:09:51
the extent because there was no remorse.
1:09:54
He was offered a chance to stand up
1:09:56
and talk to the family or the community.
1:09:59
And he didn't even say no, sir.

When the judge addressed him, he just not.
1:10:04
And to me, that
1:10:06
was, like, wow. He has zero
1:10:09
remorse or even care
1:10:11
for how the community is feeling
1:10:14
about what happened. There's there's
1:10:16
no regret in his in
1:10:18
anywhere in him. We
1:10:20
also asked Linden about the malicious
1:10:22
harassment charge in Washington state,
1:10:25
which really is a dressed up and more presentable
1:10:28
phrase for the term hate crime.

Vancouver and beyond in regards

to the actual penalties associated with

this particular type of charge. Yeah.

something that the task force necessarily. Well,

this is not something the task force is behind,

but something that I would like to see in Washington

State is more robust hate

crime law because malicious

harassment, if you look

at the definition, doesn't actually
1:11:03
include death. It's that
1:11:05
someone's property was destroyed, that
1:11:07
someone experienced a verbal or physical
1:11:09
assault, but it doesn't address death,
1:11:12
which is one of the parts that I
1:11:14
I see in being such
1:11:17
below sentence. The malicious harassment
1:11:19
only added a year and a half to
1:11:21
his sentence. It didn't actually add much
1:11:24
time. And so when people are like
1:11:26
US bound guilty of a hate crime, that
1:11:28
gets really tricky because just because
1:11:30
malicious harassment is a hate crime in
1:11:32
Washington state. doesn't mean it's
1:11:34
the same as what we think of when we think of
1:11:36
a hate crime at at the federal level.
1:11:39
Through
1:11:39
so much pain and trauma, we
1:11:41
wanted to learn more about the proverbial
1:11:44
light at the end of the tunnel, or
1:11:46
if there even was one. The
1:11:48
change that did occur as result of this
1:11:51
tragedy was Nikki's law.
1:11:53
And Linden takes us through the process of

how it came to be, and how it
1:11:57
is affecting communities nationwide

it to

this very day? So

the bill that was passed in Nikki's name

originally had been brought forward by

some local commissioners

in Washington State, and it stalled

out initially because everyone

voting Democrat and Republican also,

we don't have a need for this. This doesn't happen

in our state. We don't need a build

that fans something that's never

happened. And it was the next
1:12:25
year that Nikki went

missing that and they did a rush push
1:12:29
through it to get it passed into law
1:12:31
in early twenty twenty?

Since Nikki's law passed in Washington state,

Several other states have also followed
1:12:39
suit, banning the gay or trans panic
1:12:41
defense altogether. And
1:12:43
while the majority of states in the US
1:12:45
still allow this defense. Advocacy
1:12:48
groups such as the justice for Nikki
1:12:50
task force are currently and
1:12:52
actively pushing to end the legal
1:12:54
strategy throughout the country entirely.

was murdered, her husband, Nikki's

father contracted at COVID-nineteen. With

prior health complications, he would tragically

pass away due to the severity of
1:13:50
his illness. Before

our discussion came to a close, we wanted

to get Linden's thoughts on one last

thing. We wanted to gain a

better understanding of what the root of

this particular vein of violence might
1:14:03
be, where it comes from and
1:14:05
why gay and trans individuals? specifically
1:14:08
people of color are more at risk.

The main point we both arrived at

is that these crimes stem from
1:14:16
fear. When we strip down a
1:14:18
very complex issue to its most
1:14:20
basic form, that's ultimately
1:14:23
what it seems to boil down to.
1:14:25
the
1:14:25
trans community as a whole is
1:14:27
susceptible to more aggression
1:14:30
and hate because culturally
1:14:33
the trans community is still very
1:14:35
misunderstood or
1:14:37
there isn't a cultural understanding of
1:14:41
transgender people or people who may
1:14:43
live in the spectrum of gender
1:14:45
instead of the binaries of gender. So
1:14:48
culturally, it's something that's not
1:14:51
known and often as humans, we tend
1:14:53
to be scared of things that are unknown to us.

It's also human
1:14:57
nature to other and to then
1:15:00
cut off from other. You know,

we're scared of what's new. understanding

of personhood versus presentation
1:15:10
leads to more violence and more hate. David

Bogdanov admitted that he rejected

gay and trans people, aside from
1:15:17
ever meeting Nikki Kuhnhausen. He
1:15:20
was disgusted by the thought of a
1:15:22
trans person. Never mind mistakenly
1:15:24
taking part in a sex act with one.

rural towns, there are

gay people, there are trans people.

others that they meet regardless of what

shape or form that they take. That's

the only way we can make a better society is
