Jill K DeWit:So Greg wrote, "I'm purchasing a property through an estate. I got a signed purchase agreement back from the attorney of the estate of the deceased. It sounds like probate is open and there is a short certificate showing authority to conduct business of the deceased, as the deceased. The property owner died out of state." Hold, please. There we go. "My attorney is telling me that the seller needs to open an ancillary estate where probate is located and wait until that ancillary estate is closed before buying it. There's a risk if they don't open and close the ancillary estate that there will be a cloud on the title. Does this sound right to anyone?"
