You're on with Mario Lopez. It's
0:03
up here on with Mario Lopez. Joined me now in studio
0:05
from both the Netflix and Hulu documentaries
0:08
about Fire Festival. Seth Crossno
0:11
and his attorney Stacy Miller.
0:13
Welcome to the show, gentlemen. How you doing great?
0:15
Man, Thanks for having us, Thanks for coming by.
0:17
North Carolina's right right like it out
0:19
here in l A. Yeah, it's beautiful. Well
0:22
it's it's it's nice. And then what you attended
0:24
over there at the Fire Festival, at least
0:26
it looks that way. So, Seth, what were
0:28
you expecting when you got there? Man, Well,
0:30
we thought it would be you know, what was
0:33
advertised, you know, and we had
0:35
purchased a lodge. Who's wish my
0:37
friend Mark and I. So this is all Mark's idea.
0:40
He taught me into it, and I went to kind
0:42
of parody the influencer kind of angle.
0:44
I'm a comedy writer and so I thought
0:46
this would be funny. But I still thought we'd get
0:49
what was advertised. And so when
0:51
we showed up and saw you know, the
0:54
tents and the Amazon boxes and mattresses
0:56
everywhere, that was not what what
0:58
we expected at all. How long were you there
1:00
before you realized what was going on, probably
1:04
about half an hour, because
1:06
really, once we got to
1:07
the to the main house,
1:10
I'm thinking, well, our lodges around
1:12
the corner, you know, maybe they're still setting up, Like the
1:15
festival starts officially tomorrow,
1:18
so maybe this is just like last
1:20
minute prep or something, and maybe right
1:22
around the corner our stuff will be ready. And and that
1:24
was not the case. So wow,
1:26
And you're a comedy writer, you said,
1:29
you said so in a weird way. Doesn't
1:31
that provide a lot more material for you? It did?
1:33
And then so it's kind of sort of
1:35
a blessing in disguise. Yes, it was.
1:38
So how did you How long were you
1:40
there? And how how did you men eventually make
1:42
it back? So we got there probably five
1:44
or six on Thursday evening, made
1:46
it back to Miami by bottle eleven o'clock
1:49
Friday morning. Oh is you're lucky?
1:51
Yeah? Yeah, we didn't have to spend the night
1:54
on the festival site like some people did. We
1:56
managed to get on the last flight out, which
1:59
was a bunch of like on and off the plane and
2:01
getting locked in the airport and all
2:03
that fun stuff. When did you realize
2:06
your social media posts were getting picked up by everyone
2:08
around ten o'clock that evening,
2:11
um, and I think it was because I just brought
2:13
a ton of extra batteries because they
2:15
had said, like, we'll have charging stations,
2:17
and I'm like, all right, I probably need to bring some batteries
2:20
smart So uh so I saw
2:22
some things get you know, posted in Billboard
2:24
and vice and stuff, and then throughout
2:27
the night like CNN would pick it up and
2:29
start calling you and stuff. And what was the first
2:32
tweet? Do you remember? I think it
2:34
was just so fire festivals
2:36
that total like total chaos. Billy's
2:38
standing on the table. It's a video of everybody
2:40
looking at him like school bus driving by music
2:43
blaring, So that must have been so
2:46
like these What blew me away when I was
2:49
watching it is that these
2:51
guys knew that inevitably
2:53
was going to be a disaster and hot mess. How did
2:55
they expect that? They just think, you guys are gonna be cool
2:58
once you got there, They get you enough liquor and be what
3:01
what was like? Do you remember what were they were saying
3:03
to what was Billy standing up there saying to you? Well,
3:05
he he just kind of was answering
3:07
one question after another. It's not like he kind
3:10
of said to everybody like,
3:12
this is an announcement, you know, I said, I thought, why
3:14
didn't you just go up on stage and
3:16
grab the microphone and say if you have a tent, go stand
3:18
inline here if you need this or that, like a
3:21
camp counselor could have done this, and so um.
3:24
He didn't really say much, and you'd kind of walk up
3:26
to him ask him a question, he'd answer,
3:29
um. But he finally just yelled at
3:31
everybody, if you have a lodge, just go get a
3:33
tent. And that's when everybody kind of rushed to those
3:35
tents that were set up and it just sort of
3:37
turned into a free for all. And what were
3:39
people saying? Just were they
3:41
freaking out? Were they
3:44
sort of in a state of shock walking around? A lot
3:46
of people were just like, this is ridiculous. Is this
3:48
thing even going on? And then once
3:50
it got darker, that's when people start
3:52
kind of getting in fights and yelling and
3:54
you hear people crying and stuff, um,
3:57
looting and pillaging and everything else going
3:59
on. I mean, that's when it became dangerous. Well
4:02
yeah, I bet and and and Stacy, why did
4:04
you decide to go after Billy McFarland
4:06
and the and the festival. Well, that's a good question. So I
4:08
woke up one morning and my cell
4:10
phone social media was just going to berserk.
4:13
Seth had tagged me in a tweet and
4:15
I've never heard of the Fire festival. I'd never
4:18
heard of jar Roll, and so I called
4:20
Seth. I was
4:22
like, Seth, you know, he didn't know if he was joking
4:24
at first, but that's all more of his
4:26
social media post. I was like, oh, he might be in some
4:28
trouble. So I called him and he was in the
4:30
Bohemian airport. And immediately when he picked
4:33
up the phone, I knew he was stressed out. And you could just tell
4:35
him the tone of his voice. He was tired,
4:38
hadn't eaton, was nervous. I
4:40
was worried about getting out of the off
4:42
the island, right, So we look, I got some friends in Miami.
4:45
I went to law school for a year down there. You need
4:47
some help, we can get you because no, I think I'm getting
4:49
ready to fly out. And I said, when you get to
4:51
Miami, called me. So he called
4:54
me when he got to Miami. You were friendly before,
4:56
Yeah, we knew each other. Yeah, absolutely,
4:58
that's a good cliver. Yeah, and so he by
5:01
the time he came back up to Raleigh, UM,
5:03
the class action laws who had already been filed
5:05
by Garrigos Is firm, and we had
5:07
to make the decision whether we wanted to participate in
5:09
that class action or file on individual
5:12
case. And it sort of came up
5:14
quickly apparent to me that that the
5:16
first person across the finish line was
5:18
going to be in the best shape, and so
5:20
we opted not to participate, and
5:23
we figured out a way to soothe them in North Carolina,
5:26
and we got a verdict of five million dollars and
5:28
so we were first. We're sitting first, which
5:30
is very helpful. Yeah, congrats,
5:32
thank you smart, well played gentlemen.
5:35
Do you think you'll actually get any money from Billy?
5:38
We do, Um, there's a lot of things we have
5:40
found out. It's interestingly enough,
5:42
during the course of this Netflix documentary,
5:45
we have a lot of information. Um.
5:48
We think we are going to satisfy that judgment um,
5:51
hopefully soon. But we have to be sort of
5:53
circumspect about how how we do that because
5:56
there's a lot of other people circling around. I
5:58
mean, comes down to it, I mean, honest gosh,
6:00
this this Billy McFarland was like a millennial
6:04
made off, right. He defrauded
6:06
everybody, investors,
6:09
the supermodels, the
6:11
airline company, UM, a
6:13
lot of the artists, the consumers,
6:16
and the workers down there in the Bahamas,
6:18
and so everybody he touched he defrauded.
6:21
Did he have a history of this, He does
6:23
have a history. He ran a company called mcneiceus
6:26
UM, which was a bit of a scam, and
6:28
so he you know, and then once he was arrested
6:30
and indicted, UM, got
6:34
out pending sentencing, and
6:36
then turned around and did the same thing again, started
6:38
another scam, started another scam. And
6:41
it takes a special person to do that. Yeah, yeah,
6:43
he dedicated, dedicated.
6:47
Um, he's in prison at the moment, correct,
6:50
what did He eventually get sentenced with six
6:52
years from money laundering for money
6:54
laundering and so he got twenty just under twenty
6:57
seven million dollars uh with a
6:59
fraud. And I think fortunate thing for him was
7:01
he was prosecuted in the Southern
7:03
District in New York. Made Off
7:05
was prosecuted where a lot of the the
7:07
Wall Street prosecuted,
7:09
so those judges were used to see him. Big numbers had
7:12
he been in the Middle District or the Eastern district of
7:14
North Carolina, I can assure you he would
7:16
have gotten more than six years. Really
7:19
wow, And why
7:22
has jahn rule avoided
7:24
any sort of legal drama
7:26
repercussions. We met
7:29
with jar Roules lawyer, and
7:31
we have come to the understanding
7:34
to go on to other business opportunities.
7:36
Ah
7:39
okay, not said. Now,
7:43
this is this is fascinating. You two have a podcast
7:45
about the festival called dumpster Fire
7:48
great titles, So so what
7:50
what's the pot all about? So it originally
7:52
I got back and I thought, well, let's
7:54
just tell the stories of some of the other people that went
7:56
and how they got involved and how they heard about it,
7:58
and and then just
8:01
things kept happening like this was before Billy had
8:03
been charged and before Billy's second scam,
8:05
and before we had the five million dollar verdict.
8:07
And then I also filed, um, you
8:10
know, a trademark for Fire festival, which is a whole
8:12
another story. UM. So we're kind
8:14
of chronicling all of these stories, UM
8:16
and the fraud that Billy was you know,
8:19
committing before, during, and
8:21
after the festival, UM through
8:23
the kind of dumpster Fire UM
8:25
angle. Because the whole thing is a dumpster fire?
8:28
Are you learning? Are continuing to learn
8:30
about it? So you'll you'll interview somebody
8:33
and they'll talk about a story they heard where Billy
8:35
might be earning rental income
8:38
off of property in this city and he might
8:40
be doing this. So it's like, you know, we have to verify
8:42
these stories before we go
8:44
on record stating them. But you just learned
8:46
so much talking to people kind of casually
8:48
and off the record. So where has all the money
8:51
gone from the festival? That's a good
8:53
question. Um, we don't know the
8:55
answer to that completely. I
8:57
mean I had a fraud cases all the time,
8:59
right, not every fraud case that handle involved
9:01
supermodels were the Bahamas?
9:04
Right? But it's a sexy it's
9:06
a bit of a sexy fraud case. Yeah. But but
9:08
but fraudsters or you know, they sort
9:11
of do the same things. You can sort of follow the money.
9:13
It takes you a little while the reason to
9:15
believe there might be some money um off
9:17
shore so to speak. Okay,
9:19
Um, does he face
9:22
more repercussions when he gets out
9:25
of or done with this sentence? Um?
9:28
Billy, We've heard through talking
9:30
to some people that there are possibilities
9:32
that the things that the bankruptcy attorney and
9:34
the bankruptcy receivers are finding.
9:36
There may be additional charges brought, but
9:39
you know, we don't know from We
9:41
can't speak on those, but there's I mean, it's
9:44
you know, like you mentioned, the Southern
9:46
District of New York does these
9:48
huge, huge cases. And if this thing weren't
9:51
just delivered on a platter on social media
9:53
and through the reporting to work to her, Yeah,
9:56
it was just like, all right, why are fraud? This
9:58
fraud? I mean, he could have had a lot more kind
10:00
of on his plate. But how much
10:02
time you think we would have got in North Carolina? Well,
10:05
the guidelines I'd have to go back look at the federal gudlines.
10:07
But for the amount,
10:09
I mean, he'd have been in twenty years or so. Look at that.
10:12
By the way, deserve that after all those
10:14
things, you know what I mean? Seriously, Um,
10:16
because I know you were in both fry Fest
10:19
Ducks. Who do you think told the story better? I
10:21
think the Netflix film told the story
10:23
better of what happened. Um,
10:26
And it kind of was a I
10:29
prefer that film better, or prefer that
10:31
film? Um? The Hulu documentary,
10:33
Uh did go into the magnesia stuff a little bit more,
10:35
which was interesting. But that's part of what
10:38
we're covering on the podcast is there's a hole behind the
10:40
scenes there as to why Hulu put their's
10:42
out on the Monday before the Netflix
10:44
one came out when they originally wanted to do a multi
10:46
part series. So there's a lot of
10:48
stuff there, especially with both of them
10:50
being um involved with Billy,
10:53
so you know who paid him? When did they
10:55
all that come? And Billy was in the Hulu one.
10:58
Yes, he interviewed in the Hulu one and
11:00
he denied everything. Yeah, it was pretty
11:03
much a wasted interview. You know. It's
11:05
just like kind of yeah, sort of associate
11:07
path just to get him there. Has this, uh
11:10
consumed the standback? What's
11:13
that? Has this? Has this consumed the standback?
11:15
Does it pretty much deal with
11:18
with this episode in your life? Um?
11:22
What do you mean? Well, you said you were a comedian?
11:25
Correct? Oh? Oh yeah? Did I did I
11:27
hear that? Yeah? So I'm a sort
11:29
of comedy writer, set comedy writer. I'm sorry,
11:31
I I took it as a stand up
11:33
comment. Yeah, because
11:37
if you were a standard comedian, how great would that be? Right?
11:40
Okay, good, I'm gonna go clarity on that. All right, I
11:42
want to put you on the spot. Quick questions, quick answers.
11:44
Okay, go to karaoke song
11:48
and I guess they'd have to be something Jo Rule. There

12:12

12:16

12:21
I know a lot of people that have been done that lately, and
12:23
that's a commitment. I'm only on season
12:25

12:32
