Click that little bell icon. A lot of people have

1:46

asked if I came up with that from the song

1:48

Ring My Bell and the answer is yes. I think

1:51

in lyrics y'all all day every day. So

1:54

it just popped in my head one day and never left. So

1:56

there you go. Music fact of

1:58

the day from my favorite movie. of

2:00

all time Greece, Frankie Valli sang the

2:03

theme song Greece. He had the choice

2:05

of either singing the song or appearing

2:07

in the film. He chose

2:09

to sing the theme song and

2:12

former teen idol Frankie Avalon accepted

2:14

the opportunity to be

2:16

Frenchy's guardian angel and sang

2:18

beauty school dropout. Teenage

2:21

ne'er do well. Love that movie. Never

2:23

gets old. I watch it like once

2:25

every three months. After lunch, Miss Alice

2:27

Gilbert was still on direct with the

2:29

prosecutor Lindsay Blake. One of the last

2:31

things that she was asked before lunch

2:33

was if she was given any details

2:35

on how Lori's daughter died and she

2:37

did not. After Tammy's death, Emma was

2:39

sick and so she would take her

2:41

meals and clean her house just to

2:43

help her out. She learned JJ and

2:45

Halle were missing in November of 2019.

2:47

She found out Lori was their

2:50

mother and also that Lori and Chad

2:52

were now married. She called Chad and

2:54

asked if these were Lori's kids and

2:56

he told her yes. He

2:58

said it was a custody battle and

3:00

everything would be fine. Emma was the

3:02

one who told her that Chad and

3:04

Lori had been married. At one point

3:06

Chad came over and showed Alice and

3:08

her husband their wedding photos. She said

3:10

he was very excited to show those.

3:12

This visit was probably two weeks after

3:14

Chad and Lori first visited them. She

3:16

was surprised they got married because initially

3:18

they said they didn't know when they

3:20

would get married. He came another time

3:22

after Lori was arrested in Hawaii and

3:24

moved back to Idaho. He

3:26

asked first of all if he could stay

3:28

there. At first it was just

3:31

overnight and she said she was okay for

3:33

an overnight stay. She was not comfortable with

3:35

him staying there for any length of time

3:37

so they told him their daughter was moving

3:40

in. When he came

3:42

in he was very upset and was crying

3:44

saying that he had to get Lori out

3:46

of jail. It was killing her being in

3:48

there so he asked if they could put

3:50

their house up for Lori's bond. They asked

3:52

Chad if he had any family to ask

3:54

and he said no. They

3:56

told him they would think about it and this was on

3:58

a Saturday. The very next day He

4:00

wanted to bring the bonds woman to their

4:02

house to meet them. They decided they were

4:05

not going to put their house up for

4:07

Lori's bond. She did ask him how many

4:09

daughters Lori had and Chad said one. Then

4:11

the witness said, you told us her daughter died when

4:13

we asked if she had kids. And

4:15

she said, Chad denied that he said that

4:17

to her. And she says, you did.

4:20

When asked about the bond, she was kind of

4:22

missed that he asked that. So

4:24

she asked, where are the children? And she gets

4:26

emotional on the stand. She asks,

4:28

where's Tylee? Tylee's a teenager. Doesn't

4:31

she want a life? A boyfriend?

4:33

Chad said Tylee didn't like people

4:36

and she didn't like me.

4:40

What the witness picked up on was

4:42

him using the past tense when talking

4:44

about Tylee. They go back in time

4:46

a bit to February of 2019. Chad

4:50

was at their place. The couple were

4:52

working on a bedroom floor and

4:54

as Chad was leaving, he mentioned that he had a

4:56

vision that Tammy would pass away.

4:58

He didn't know how or when,

5:01

but he said it would be before her 50th

5:03

birthday. Chad also told the witness

5:05

and her husband that Tammy liked playing computer

5:07

games. And he told her

5:09

that her deceased grandmother came to him

5:11

and said she wasn't happy with Tammy on

5:13

the computer and that she was wasting her

5:16

time. The witness did say that when Chad

5:18

made the comment about Tammy dying, Tammy didn't

5:20

have any health issues. And the witness kind

5:22

of just passed it off on cross prior.

5:24

Prior asked how often she saw Tammy. She

5:27

said they met on Wednesday mornings for an

5:29

hour or two and there were four of

5:31

them that met. And then she would see

5:33

her on Sundays. They would sit

5:35

with the day bells at the second meeting sometimes

5:37

at church, but not in the first meeting. Their

5:40

church services lasted about two hours. He

5:43

asked about where the day bells sat in

5:45

church and she said in the middle until

5:47

Emma gave birth to her child and then

5:49

they kind of moved towards the back. Prior

5:51

asks if Chad would park his truck at

5:54

church every morning and the witness doesn't know.

5:56

He talks about the funeral and she knew

5:58

that Tammy's family was from Spain. and

6:00

she didn't think it was unusual that the funeral was held there.

6:03

Back to when Chad came to their house October 26th of

6:05

2019, Chad

6:08

said he met Lori in Utah back in

6:10

2018. And

6:13

he asks if the witness knew Lori

6:15

through Melanie Gibb, his favorite

6:17

person to talk about. But she says yes.

6:19

Pryor says that Gibb is deeply involved in

6:21

the preparing of people movement. There's

6:23

an objection that's sustained. Pryor asks how she

6:26

knows Gibb, and the witness doesn't remember how

6:28

they came to know about Gibb's podcast, but

6:30

they did listen to it. And

6:33

that's where she heard of Lori Valo

6:35

was through Melanie Gibb's podcast. Pryor

6:38

brings up Disneyland and that

6:40

trip around Thanksgiving and ask if it's

6:42

possible. Chad said Knott's Berry Farm.

6:45

The witness was adamant she heard Disneyland. Pryor

6:48

really sticks his foot in it with

6:50

these next couple of witnesses about the

6:52

upstairs, which is the other day. Remember

6:54

he was trying to discredit the cousins saying that

6:57

there was only one level to the house. Pryor

6:59

asks the witness if the house is one

7:01

story. She said there's an

7:03

addition and you walk through a breezeway and

7:05

then there are stairs. Pryor

7:08

asked if she's aware the addition

7:10

doesn't have power. There's an objection,

7:12

which is sustained. The prosecution said

7:14

Pryor is just testifying. Pryor

7:16

says I'm asking. At this point, Judge

7:19

Boy seems very annoyed with Pryor and

7:21

he says there's a proper way to

7:23

ask. She has been inside the addition,

7:25

but she doesn't know what utilities are

7:28

in there. Pryor asks if she's aware

7:30

nobody uses that space. There's an objection

7:32

to sustained. He asked if she

7:34

knew of any family who uses it and she knew

7:36

Garth had a ham radio and

7:39

a drum set that she thought was in there. She

7:41

said she doesn't know their living conditions, but

7:43

she knew where Tammy's room was in that main house.

7:46

Pryor goes on to ask her whose bedroom is whose

7:48

and she doesn't know as far as the kids go.

7:51

They bring up at the time of Tammy's passing Garth

7:53

was living at home and she didn't know if Seth

7:55

was or not. Mark was coming

7:57

home from his mission and probably would

8:00

have lived there. The other daughter, Leah,

8:02

lives in Utah. Prior points out that the

8:04

talk about going to Disneyland was in October

8:06

and he asked if Chad was trying to

8:08

hide his whereabouts and the witness says no.

8:11

Prior says that Chad openly discussed his plans

8:13

for the future. And she said that he

8:15

told her he was going to Hawaii to

8:17

write a book. Prior asked if she got

8:20

the impression when talking to Chad about the

8:22

kids, if she felt the kids were still

8:24

alive. When he talked about them, she

8:27

said she felt he was avoiding the topic

8:29

and she couldn't get a straight answer out

8:31

of him. Prior talks about when Chad told

8:33

her when the truth comes out and this

8:35

is a custody case, you didn't

8:37

get the feeling the truth would come out and

8:40

the children's whereabouts would be told to everyone. She

8:43

said, that's what he said, but prior

8:45

interrupts and says he has no further

8:47

questions on redirect. Lindsey Blake asked, do

8:49

you know where Chad went every morning?

8:51

She has no idea, but she knows

8:54

he did go to the BYUI college

8:56

campus. Prosecutor says you've been inside the

8:58

home. Are there stairs in there? Of

9:00

course, prior objects and that's overruled. Lindsey

9:02

Blake says to be fair, there's more

9:05

than one story to this house. And

9:07

she says, yes, prosecutor says the Chad

9:09

talked about future plans. The witness says,

9:11

go into Hawaii, but they did

9:13

talk about marriage. He didn't know when or where

9:15

it was going to happen. The prosecution says

9:17

Chad referred to Lori's daughter as dead.

9:21

There's an objection that's overruled. Chad

9:23

mentioned Lori had a daughter who had

9:25

just passed away. Then prosecutor Blake says,

9:27

are you aware Lori's children were found

9:29

on Chad's property? The answer

9:31

was yes. That was all for her.

9:34

The next witness, Todd Gilbert, Ms. Alice's

9:36

husband, he had heard of Chad as

9:38

an author in 2015 and had read

9:40

most of Chad's books before he met

9:42

Chad in person. They moved into

9:44

the neighborhood with Chad and Tammy in March of

9:46

2017. And of course

9:49

they met the whole family. They were in the

9:51

same ward as Chad and Tammy and within a

9:53

week of moving, they met. He said he knew

9:55

Chad better. He'd see him once or twice a

9:57

week, depending on the time of the year. Mainly

9:59

it was. at church, but he would

10:01

see Chad outside or sometimes Chad would ask

10:03

him to come help with plumbing stuff. Chad

10:06

did discuss some of his beliefs with the

10:08

witness. He said they didn't ring true to

10:10

him, but he has no reason to doubt

10:12

that Chad had visions. Chad was in the

10:15

process of finishing the second book series in

10:17

2019 and they would talk about some of

10:19

the events in the book, which Chad says

10:21

came from his visions. And some of those

10:24

were also fictional. The witness said they'd

10:26

talk about the events Chad had visions of.

10:28

He said he didn't feel Chad was trying

10:30

to teach him per se, but was just

10:33

telling him about things that were going to

10:35

happen. The things Chad talked about didn't always

10:37

go with standard LDS doctrine, but the

10:39

witness was willing to listen. He thought it

10:41

was interesting, even though he did not hold

10:44

the same beliefs as Chad. They talk about

10:46

that February 2019 visit

10:48

where Chad texted and said he wanted to

10:50

come over and talk. They talked about a

10:52

bunch of things. And this is when Chad

10:54

was leaving. He said Tammy's life mission was

10:56

going to end and she would die

10:58

before she turned 50. Like his

11:00

wife, Alice, he learned of Tammy's passing

11:02

the morning of October 19th. He

11:05

says they got a call around 7am from

11:07

Emma who was crying. Chad took the phone

11:09

and then pulled of her death. They went

11:11

over to the house around 8 15 that

11:13

morning, not too long after Tammy had been

11:15

pronounced dead. He noticed when they walked in

11:17

the living room, all the kids except Mark

11:19

was there sitting on the couch and Chad

11:21

just did not seem sad. Like

11:23

you would expect somebody to be when your

11:25

spouse dies suddenly. He said it seemed very

11:27

business like he said Chad's demeanor was hard

11:29

to figure out because he's very soft spoken

11:32

anyway. That day he was talking to Chad

11:34

and the witness said, well, it looks like

11:36

your vision must have happened. Chad turned his

11:38

back to his kids and says the kids

11:40

really didn't know about that. He had

11:42

not told them about his vision of their

11:45

mom dying. He goes through the midnight coughing

11:47

spell threw up, went back to bed. Chad

11:50

told the witness he figured Tammy died

11:52

around 2am from an embolism and the

11:54

witnesses, I don't know how Chad knew

11:56

that then around 5 30 she rolled out

11:59

of bed. to the floor partially. That's

12:02

when he yelled for Garth to come help

12:04

get her back on the bed. The prosecutor

12:06

says, so she dies at 2 a.m. and

12:08

then three or four hours later she rolls

12:10

out of the bed and the witness says

12:12

yes. The witness said they would see Tammy

12:14

at Walmart, at church, out in the yard

12:16

if they drove by and she always looked

12:18

fine. He never noticed anything about her

12:20

health that would make him think it was

12:22

failing in any way. He noticed Chad and

12:24

Tammy's interactions when they first moved in the

12:26

area. He was assigned to go to Chad's

12:29

home through their ward. Chad would

12:31

be on the couch holding hands with Tammy and they

12:33

would do the same at church. He said they sat

12:35

closer to the front but at the start of 2019

12:38

they were moving towards the back and

12:41

their demeanor he said was separate from

12:43

each other. The day Tammy died they

12:45

asked Chad if the family would like

12:47

breakfast so they went to McDonald's and

12:49

when they got back more people had

12:51

shown up. Garth told them to

12:53

leave the food on the kitchen table.

12:55

The day after the funeral and the

12:57

night of the Idaho Memorial they took

12:59

dinner to the house around 6. That's

13:02

when Chad told the witness he's got to move out.

13:05

He said he can't stay here anymore and that

13:07

he had a friend on Pioneer Road who had a

13:09

townhome and wasn't there much and he was going to

13:12

move in with them. He kind

13:14

of laughed and says I didn't think

13:16

it was a woman. So Tammy's funeral

13:18

was October the 22nd in Utah the

13:20

Memorial in Idaho the very next day on

13:22

the 23rd. He

13:24

said the timing of Tammy's funeral struck him as

13:27

being hurried. He said it just seemed fast to

13:29

have a funeral for your spouse who you're in

13:31

love with. At the funeral they went into the

13:33

viewing area. Chad and the kids are in there

13:36

as well as both Chad and Tammy's relatives. Chad

13:38

was there at the head of the casket. The

13:40

witness felt like he was in a hurry to

13:42

get all this over with. A week after Tammy's

13:44

death that Saturday it would be good to bring

13:47

Chad a pizza. So they called at 5 30

13:50

and offered to come to his new place but Chad

13:52

said he would come to them. He

13:54

got there in 30 minutes around six o'clock.

13:57

Chad sat at the table, he was seemed

14:00

hesitant and said he wanted to tell them

14:02

something, which is he has a girlfriend. The

14:04

witness said they about fell in the floor.

14:06

Chad seemed hesitant to say her name, but

14:08

he did say Lori Valo. And the witness

14:10

thought the name was familiar. And then he

14:12

realized he had heard her name on one

14:14

of the Gibbs podcasts. Chad told the witness

14:16

Tammy's mission was over. And the second half

14:18

of his life was to be with Lori

14:20

and she was to help him with his

14:22

mission. He also added in Lori was beautiful.

14:24

Chad said that Lori and her friends would

14:27

be in the area and asked if they

14:29

wanted to meet. And they said, sure.

14:31

The witness and his wife were working at the

14:33

temple on Tuesdays, taking the night shift. Chad told

14:35

him Lori and some friends would be in the

14:37

temple and they would try to meet up. He

14:39

meets Lori at the temple for the first time.

14:41

Of course she was with Chad. And

14:43

then he talks about Chad and Lori coming

14:45

to their house two or three days later

14:47

after they first met. He said they

14:49

were very happy and excited to be with each other

14:51

and they invited them inside. He

14:53

said, Chad and Lori were holding hands and

14:56

he saw Chad rubbing Lori's leg. He thought

14:58

it was odd with Tammy dying just a

15:00

week ago. And then you have Chad acting

15:02

like this teenager in love. He never

15:04

saw that kind of affection with Tammy. Chad

15:06

and Lori told them they would eventually end

15:09

up in Hawaii and live there permanently once

15:11

they got things wrapped up in Rexburg and

15:13

eventually they would get married. He goes through

15:15

the same thing as wife talked about where

15:17

Lori said her husband had died of a

15:19

heart attack in December of 2018. When

15:22

they asked about kids, she said several.

15:25

Chad popped up. That's when he

15:27

said she had a daughter that just

15:29

died. And he notes, Lori did not

15:32

correct him. They never mentioned Lori having

15:34

a minor son. After that visit, they

15:36

came back about two weeks into November

15:39

to show wedding photos. He

15:41

said it was quite a few and off

15:43

the top of my head, I think I

15:45

remember hearing there were over 700 photos taken

15:47

the day they got married. They also talked

15:49

about how they were going with Chad's kids

15:51

to Disneyland and Knott's Berry farm. Of

15:53

course, no mention of JJ or Tylee

15:56

Chad and Lori told them they had been married

15:58

a week before they showed up. to their house.

16:01

Did you know that traditional bed sheets

16:03

can harbor more bacteria than a toilet

16:05

seat? It can lead to acne,

16:07

allergies, and stuffy noses and it's

16:09

Ever tried to break a bad habit

17:18

and felt like you're just swimming against

17:20

the tide? We've all been there but

17:22

here's a breath of fresh air. Fume.

17:24

It's not about giving up it's about

17:26

switching up. Fume takes your habit and

17:28

simply makes it better, healthier

17:30

and a whole lot more enjoyable.

17:33

Fume is an innovative and

17:35

award-winning air device that does

17:37

just that. Instead of vapor,

17:39

fume uses flavored air. Instead

17:41

of electronics, fume is completely

17:43

natural and instead of harmful

17:46

chemicals, fume uses delicious flavors.

17:48

Your fume comes with an adjustable

17:50

airflow dial and is designed with movable

17:53

parts and magnets for fidgeting, giving your

17:55

fingers a lot to do which is

17:57

helpful for de-stressing and anxiety while breaking

18:00

your habit. The

18:25

prosecution asked, who was in the wedding photos?

18:28

Was there a teenage girl? Was there

18:30

a minor boy? Was Alex Cox, Melanie

18:32

Gibb? No, just Chad and Lori. Chad

18:35

also told the witness his kids were fine

18:37

about Lori. He said Tammy had

18:39

appeared to him two times in spirit since

18:41

she passed and she was fine. He was

18:43

married to Lori and she was okay with

18:46

her kids accepting that. That was very odd

18:48

to the witness. He talks about Chad coming

18:50

back asking for them to put their house

18:52

up for Lori's bond after she was extradited

18:54

to Idaho. He walked in

18:56

and Chad said that Christ sent him there to

18:59

ask if you'd be willing to put your home

19:01

up to get Lori out of jail. They

19:03

were like, no. He remembers hearing Chad

19:05

say Lori's daughter didn't like him and

19:07

would stay away from him. He's been

19:09

inside the Daybell house and confirms there's

19:11

a set of stairs that are in

19:13

that back part of the home in

19:15

that addition. On cross, the last question

19:17

was about a part of the house

19:19

that has stairs. Pryor

19:21

talks about the one story part of

19:24

the house being brick and the back

19:26

is an attached building with stairs. He

19:28

says it's almost like a garage. There's an

19:30

objection. Prosecution says

19:33

he's testifying. That was sustained.

19:35

So Pryor asked the witness, how would he

19:37

describe it? He said it

19:39

was storage and mechanical downstairs. And

19:41

then above that was a room. Then Pryor

19:43

talks about they didn't really use it much.

19:46

Maybe Garth, lots of objections

19:48

be sustained. The witness says the whole

19:50

family used it and there was

19:52

actually a bed upstairs. Pryor asked if there's

19:54

a computer or any kind of office furniture

19:56

and he says no. The witness also doesn't

19:58

think there was heat. up there. He

20:01

asked about Gibb. The witness

20:03

listened to her podcast and Prior asks

20:05

if she is part of preparing a

20:07

people and he says to his knowledge,

20:09

not really. He talks about preparing a

20:11

people, had a conference in Idaho in

20:14

February of 2019 and Chad

20:16

introduced the witness and his wife

20:18

to Melanie Gibb. She spoke at

20:20

that conference. Prior asks if Chad

20:22

made any comments about Tammy's health

20:24

or impending death and the

20:27

witness did not remember those comments at

20:29

the conferences, by the way. He and

20:31

his wife attended three of those. Prior

20:33

asks about AVOW which is a voice

20:36

of warning. The witness says it's

20:38

a preparation website. Prior points out

20:40

prepping isn't inconsistent with LDS faith

20:42

and there's nothing that says you

20:44

cannot be a part of these prepper

20:46

groups and the witness agrees. Prior says

20:48

the writing of the fiction books doesn't

20:50

preclude him from being a part of

20:52

the LDS faith and he's entitled to

20:54

express his belief versus what someone else

20:57

in the LDS faith believes and the

20:59

witness agrees. He moves on to meeting

21:01

the lorry at the temple and Prior

21:03

asks if there's a limitation of who

21:05

is allowed in. The witness says

21:07

active members and they have to have a temple

21:09

recommend from the bishop. The bishop will

21:11

ask you questions to see if you're

21:14

living the gospel. Prior asks who all

21:16

was there. He remembers Melanie's but does

21:18

not know the other lady. I'm wondering

21:20

maybe if this isn't when Zulema went

21:22

up to visit because he would know

21:24

Melanie Gibb. Prior asks if lorry told

21:26

him Tylee didn't like Chad and the

21:28

witness says it seems that was more

21:30

Chad's feelings. Prior says

21:32

that Chad is soft spoken and shy and the

21:35

witness agrees. The witness thinks that this was about

21:37

a week after they got married where they talked

21:39

about taking this vacation. Prior brings up Tammy's death

21:41

again and Chad just said it was an embolism

21:44

and when they found her in the morning he

21:46

had to call guards who helped pick her up

21:48

off the floor and put her back in the

21:50

bed. On redirect, Lindsey

21:53

Blake asks if preparing a people attached to

21:55

the LDS faith that's a big no. Were

21:58

some of the things Chad told you? talked

22:00

about beyond standard LDS teachings, yes. For

22:02

a temple recommend, if someone disclosed they

22:04

were having an affair, would they qualify

22:07

for a temple recommend? That's a no.

22:09

She asked, you were told Tammy died

22:11

around 2 a.m. and then rolled out

22:14

of bed several hours later. The witness

22:16

says yes. Lindsey Blake, no

22:18

further questions. The next witness is

22:20

Janice Olson. She is a

22:22

30-year veteran teacher. She teaches first grade

22:25

currently and has worked her entire career

22:27

at the school Tammy taught at. Shout

22:30

out to Ms. Olson, not an easy job.

22:32

She would see Tammy several times a day

22:34

all over the school. They would eat

22:36

lunch together three to four times a week. She

22:39

said Tammy was just a good colleague and a

22:41

good friend to her. She said Tammy was organized.

22:43

She went above and beyond to get books into

22:45

the hands of kids. Tammy

22:48

would come gather books if it was

22:50

that class's library day and then the

22:52

teachers would bring their classes to the

22:54

library. Tammy also came to their high

22:56

fitness Zuba class twice a week. Those

22:58

classes went on for about an hour

23:01

and she was a regular attendee. Tammy

23:03

followed along like everybody else in there.

23:05

No struggles while in class. She didn't

23:08

fall behind and she never

23:10

had to stop class early. She said

23:12

Tammy was active and healthy. She was

23:14

shocked when she heard about Tammy's death.

23:16

A student's mother who worked with Tammy

23:18

in the church calling called to let

23:20

her know that morning that Tammy was

23:22

dead. She had just seen

23:24

Tammy the day before. She was killed and

23:26

interacted with her. Tammy didn't complain

23:29

of any physical problems and the witness

23:31

didn't see anything concerning as far as

23:33

her health went. Tammy had been at

23:35

fitness class that week and never complained

23:37

about anything. On cross,

23:40

Pryor asked if the students were brought

23:42

to Tammy for library time and she

23:44

wouldn't have to walk all across the

23:46

school. The witness says

23:48

that's correct. Then Pryor says

23:50

as part of their library hour, the teacher

23:52

would gather the students, walk

23:55

them to the library and then return an hour

23:57

later to pick them up and take them back

23:59

to class. asked if Tammy was

24:01

really busy getting ready for a book fair

24:03

that Friday and the witness doesn't remember.

24:06

On redirect, this witness's classroom is

24:08

by the front door and

24:11

as far as where Tammy would be, it

24:13

would be down the hall past the lunch

24:15

room. And the prosecution asked, is it possible

24:17

Tammy would be walking around the school and

24:19

you just didn't see? There's

24:21

an objection that's sustained. They asked the

24:23

witness if she saw Tammy walking and

24:25

she said frequently she would

24:27

walk together books before teachers took their

24:29

classes to the library. And

24:31

if she knew a teacher was teaching,

24:33

for example, something about insects, Tammy

24:36

would get all the books about insects that

24:38

she could and take those to the teacher.

24:41

The last witness of the day, Taylor Ballard,

24:43

she is with Ballard Insurance Group.

24:46

That's the health insurance, life insurance

24:48

and disability insurance that Tammy carried.

24:50

Chad was also her client. October

24:52

31st, 2019, he

24:55

came in because the health insurance the

24:57

whole family had through Tammy's employment was

24:59

expiring. He asked for an individual

25:02

insurance plan for himself and three

25:04

of their kids, Seth, Leah

25:06

and Mark. Idaho was looking to expand

25:08

Medicaid to adults in January of 2020.

25:11

Chad said his book business would be

25:14

working at a loss without Tammy's income,

25:16

so she asked for a copy of

25:18

his taxes to verify that. Given the

25:20

situation, she applied for Medicaid for January,

25:23

but on November 5th, she went to

25:25

the Department of Health and Welfare to apply for

25:27

him. And the interface saw

25:30

that his previous income was

25:32

higher than what he told her. So

25:34

he qualified for marketplace coverage. She texted

25:36

him November 5th, the day he got

25:39

married and asked for his 2018 taxes. He said

25:41

he wasn't in

25:44

town that week, but he would be back that

25:46

next week and would stop by. He

25:48

came into her office November 21st. She found

25:50

out he was making around 30,000 a year,

25:52

which meant he

25:55

would be eligible for different insurance. So

25:57

they talked about what options he had

25:59

and That plan would start in

26:01

January of 2020. He asked

26:03

her in a very hypothetical way, how

26:05

hard would it be to add a new wife

26:07

if he got married? And she

26:10

told Chad there's variables they would need to

26:12

discuss. Then he said, I'll be

26:14

honest with you, I'll probably be married by the

26:16

end of the year. And I'm curious about what

26:18

the process would look like. He called December 11th,

26:20

2019, to

26:23

make sure he was squared up for January.

26:25

He picked this plan and paid for

26:27

it. Never mentioned JJ or Tylee ever.

26:29

What's odd is she got five letters

26:31

addressed to Chad. It was sent to

26:33

her office. These were from the Department

26:35

of Health and Welfare and also mail

26:37

from the insurance company he had the

26:39

plan with. That's never happened

26:41

to her before. And all of their

26:44

information had the address that Chad provided

26:46

to them and not their address. On

26:48

December 23rd, 2019, she

26:51

was in the Department of Health and Welfare

26:53

doing other business. That's when she

26:55

learned Chad and Lori were married and

26:58

Lori's kids, JJ and Tylee were missing.

27:01

At first, she didn't know if JJ

27:03

and Tylee were two of the kids

27:05

she helped Chad get insurance for. She

27:08

got really confused and just did not

27:10

know what to think. Then she started

27:12

to question Tammy's death and the timing

27:14

of his remarriage seemed very fast. Her

27:16

office also dealt with Tammy's life insurance,

27:18

disability and health insurance. So

27:20

she looked at Tammy's life insurance and saw

27:22

it had been paid out. She also found

27:25

that an open enrollment at the beginning of

27:27

the school year, Tammy had upped

27:29

her life insurance policy to the maximum allowed.

27:31

Fast forward, March 11th, 2020, Lori is in

27:33

jail. Chad

27:36

comes in her office asking how to

27:38

get health insurance for Lori. The witness asked

27:40

for Lori's name and he wrote on a

27:43

sticky note, Lori Ryan Daybell and he told

27:45

her they were married November the 5th. Chad

27:47

told the witness Lori was in jail and

27:49

was worried something might happen to her. The

27:52

witness told Chad since she's incarcerated, Lori would

27:54

be covered by the state should she get

27:57

sick. Plus with the marriage on November 5th,

27:59

that was. outside that 60 day

28:01

enrollment window. Chad tells her Lori

28:03

should be getting out next week.

28:06

The witness said they could use that as

28:08

a qualifying event if she did. As she

28:10

was looking through Chad's information, just seeing what

28:12

was different and what was the same. When

28:15

she got to Chad's income, he told

28:17

her they compensated his computer and he

28:19

wasn't able to pay himself yet. She

28:22

asked who they were and he

28:24

said the FBI. Chad wanted to be

28:26

sure that himself, Lori and his son

28:28

Mark would have coverage. And the application

28:31

asks, is there anyone in your household

28:33

who needs coverage? Of course, he

28:35

never mentioned JJ or Tylee. She said at

28:37

this point, JJ and Tylee are all over

28:39

the news. So she started thinking

28:41

the insurance payout was fraudulent. And she started

28:44

to think Tammy's death may not have been

28:46

an accident and the life insurance monies were

28:48

paid out when it should not have been.

28:50

She said to her, it seemed like they

28:52

wouldn't need health insurance. The way things were

28:54

going, she told them she would reach out

28:56

when the insurance premium rates were ready and

28:58

that would be the next day. So the

29:00

next day, March 12th, she texted Chad, giving

29:02

him the rates for a household of three.

29:04

She also wanted to make sure there was

29:06

no one else in the house that they

29:08

needed to count. Chad said,

29:11

that's good. That's great. March 16th, Chad

29:13

reaches out to her because the Department

29:15

of Health and Welfare could not verify

29:18

Lori's information. Chad gave

29:20

their marriage certificate and Lori's driver's

29:22

license. On March 18th, they talk

29:24

again. She let him know the

29:26

issue with Lori's identity or information

29:28

was resolved. She last spoke to

29:30

him on March 26th about

29:32

another notice he got and she let him

29:35

know it was resolved. She

29:37

told him to let her know if anything changes

29:39

like income. He told her it's

29:41

going to be a tight year and he

29:43

doesn't see anything changing. She did the open

29:45

enrollment presentation for Tammy actually at the beginning

29:47

of the school year. She

29:50

explains in the presentation what life,

29:52

health and disability insurance looks like

29:54

for that year. When

29:56

Chad came into her office, she noticed on

29:58

November 21st, His wedding

30:01

finger he had a turquoise ring on. She

30:03

didn't know if it was Tammy's or potentially

30:06

an engagement ring. But when he came

30:08

in on March 11th, Chad was

30:10

noticeably thinner and tanner. And

30:13

on his wedding finger that had the turquoise ring,

30:15

there was a black ring on it. She

30:17

thought the turquoise must have been Tammy's and

30:20

this was his new one. On cross, Prior

30:22

points out that her interview with Officer

30:24

Mattingly, she mentioned on

30:27

October 31st when Chad approached her

30:29

about the insurance, he only asked

30:31

about Seth, Leah, Mark and Chad.

30:33

The witness says yes. For the

30:35

school enrollment, she did that presentation

30:37

August 23rd and the forms

30:39

were due to be turned in September 15th. If

30:42

there were changes, they would have been retroactive

30:44

to September 1st. Prior

30:47

asked if she's aware of the other life

30:49

insurance policy Chad and Tammy had. There's

30:52

an objection. So the

30:54

rate for the life insurance is five times

30:56

your salary. Tammy elected for $80,000 of

30:59

life insurance and I suck at math, y'all, but

31:01

if my math is right, that woman

31:03

made $16,000 a year working in a school while

31:08

Chad's traveling around, giving kitchen talks

31:10

at Lori Valor's houses. Rest are sold.

31:13

And this is interesting and I wonder if

31:15

this is something that Chad told Prior that

31:17

is a lie, which probably has been a

31:19

lot of things he's told Prior. Prior asked

31:21

if there was ever any discussion that Lori's

31:23

kids lived somewhere else in the country. She

31:25

said Lori's kids never came up

31:28

in any regard. Of

31:30

course, Prior had nothing further. There

31:32

was no follow up with the state.

31:35

Not a good day for Chad Dayville in court.

31:37

People have been very worried all day. Oh, the

31:39

medical examiner couldn't determine a cause of death. He

31:42

did and it was asphyxiation and it was

31:44

a homicide. And all

31:46

these neighbors testimonies were perfectly

31:48

placed by the prosecution to

31:51

show the motive for the murder. And

31:53

that's the very thing I think that

31:55

will get Chad convicted just like his

31:57

beloved wife. We'll see what tomorrow brings.

32:00

I think if Garth Daybell is going to testify,

32:02

it's going to be soon. Don't forget, come chat
